Terms of Use

Quick version: BarkParks is a planning tool, not an official park authority, veterinarian, emergency service, or guarantee of safe conditions. Please use your judgment and confirm important details before every trip.

1. Using BarkParks

These Terms apply when you use BarkParks.dog, related member tools, maps, downloadable planning resources, and support pages. By using the site, you agree to these Terms and our Privacy Policy.

BarkParks provides informational content about dog-friendly parks, trails, road trips, and gear. We try to be helpful and accurate, but park rules, weather, closures, and safety conditions can change quickly.

2. Not Official Advice

BarkParks is not affiliated with the National Park Service, state park systems, local park departments, veterinarians, or emergency responders. Our content is not medical, legal, or professional travel advice.

3. Accounts, Memberships, and Saved Tools

If you create an account, join a waitlist, or purchase a membership, you agree to provide accurate information and keep your credentials confidential. You are responsible for activity under your account.

  • Membership benefits, pricing, and availability may change as features launch or evolve.
  • We may suspend or close accounts that violate these Terms, harm the service, or create security risk.
  • Some features may be beta tools. They may change, pause, or be removed.

4. Acceptable Use

Please do not misuse BarkParks. That includes scraping at scale, reverse engineering, attempting unauthorized access, posting malicious content, interfering with maps or member tools, or using the site in violation of law.

5. Affiliate Links, Gear Picks, and Sponsored Relationships

Some BarkParks pages include affiliate links, including Amazon Associates or similar partner links. If you click one of those links and make a qualifying purchase, we may earn a commission at no additional cost to you. Sponsored content or partnerships will be labeled when appropriate.

6. Intellectual Property

Unless otherwise stated, BarkParks branding, copy, page design, curated lists, graphics, and original content belong to Joy, Thee & Me LLC. Map data, trademarks, and third-party content remain the property of their respective owners.

7. Assumption of Risk

Traveling, hiking, camping, visiting dog parks, and exploring unfamiliar places with pets involve real risk. You accept responsibility for route choices, park rules, weather, terrain, pet behavior, wildlife encounters, and emergency preparedness. Always use your own judgment and verify the details that matter most to your trip.

8. Disclaimer and Limitation of Liability

BarkParks is provided as is and as available. To the fullest extent allowed by law, Joy, Thee & Me LLC disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for losses arising from your reliance on site content, third-party services, or outdoor activity decisions. To the extent any liability is not lawfully excluded, our total aggregate liability to you will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or USD $100.

9. Service Availability

BarkParks is offered on an as available basis. While the service is still growing, we target approximately 90% monthly uptime, measured excluding scheduled maintenance, third-party provider outages (such as hosting, maps, or analytics vendors), and events outside our reasonable control. This is a good-faith operational target, not a guaranteed service-level agreement, and no credits or refunds are owed for downtime, slowdowns, or unavailability. We may perform maintenance or updates at any time, with notice where practical.

10. Privacy, Cookies, and Consumer Rights

Your use of BarkParks is also subject to our Privacy Policy and Cookie Policy. Those pages explain how we use Firebase, Google Analytics, Amazon Associates, and Leaflet/OpenStreetMap; how long we keep information; and how to exercise CCPA/CPRA or GDPR rights, including deletion requests.

11. Children's Use

Parents or guardians should supervise children using BarkParks. We do not knowingly permit children under 13 to create accounts or submit personal information without appropriate parental involvement.

12. Indemnification

You agree to defend, indemnify, and hold harmless Joy, Thee & Me LLC and its owners, officers, and contractors from any claims, damages, losses, liabilities, and reasonable expenses (including attorneys' fees) arising from your use or misuse of BarkParks, your content or submissions, your travel or outdoor activity decisions, your violation of these Terms or applicable law, or your infringement of any third-party right.

13. Force Majeure

We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, fire, flood, severe weather, power or internet outages, hosting or third-party service failures, labor disputes, government action, war, terrorism, civil unrest, or public-health emergencies.

14. Dispute Resolution and Arbitration

If a dispute arises, please contact us first so we can try to resolve it informally. If we cannot, you and Joy, Thee & Me LLC agree that any dispute relating to these Terms or the service will be resolved by binding arbitration on an individual basis, and you and we waive any right to participate in a class, collective, or representative action. Two exceptions: either party may bring an individual claim in small claims court, and either party may seek injunctive relief to protect intellectual property or confidential information. The arbitration and any permitted court proceeding will take place in Texas.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. If a dispute arises, the parties will first try to resolve it informally by contacting us.

16. Changes to These Terms

We may update these Terms from time to time. The updated version becomes effective when posted with a new effective date.
